1. Acceptance of these Terms

These Terms of Use (“Terms”) govern your access to and use of the TollPH website and toll calculator (the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

These Terms are a general website agreement for an informational travel tool. They are not legal advice. Have a lawyer review them before relying on them for a commercial launch.

2. Description of the Service

TollPH provides free, browser-based estimates of Philippine expressway toll fees based on selected plazas, vehicle class, and related inputs. The Service may also show educational content about RFID systems, open/closed tolling, popular routes, and FAQs.

The Service is for planning and information only. It is not:

• an official TRB, DPWH, expressway operator, or RFID issuer system;
• a payment processor for tolls or RFID top-ups;
• a guarantee of the amount you will be charged at a plaza; or
• professional legal, financial, or transportation advice.

3. Eligibility

You may use the Service if you can form a binding agreement under applicable law. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. License and intellectual property

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal or internal trip-planning purposes, subject to these Terms.

All rights in the Service—including software logic, text, graphics, logos, layout, and compilation—are owned by TollPH or its licensors and are protected by intellectual property laws. You may not copy, scrape at scale, reverse engineer, resell, or create a competing service from our materials without prior written permission, except for ordinary browsing and personal use of publicly available pages.

Toll rate figures referenced by the Service may originate from publicly available schedules or operator publications. Ownership of official rate schedules remains with the issuing authorities or concessionaires.

5. Acceptable use

You agree not to:

• use the Service in any way that violates law or third-party rights;
• attempt to disrupt, overload, hack, or reverse engineer the Service;
• use automated systems to harvest content in a way that harms site performance or bypasses reasonable access controls;
• misrepresent estimates from TollPH as official TRB or operator quotations;
• upload malware or attempt unauthorized access to our systems or other users; or
• use the Service to build unlawful datasets or to harass others.

We may suspend or block access if we reasonably believe these rules were violated.

6. Estimates, accuracy & disclaimer of warranties

Toll calculations are estimates. Actual charges can change because of approved rate adjustments, plaza coding differences, vehicle classification at the gate, promotions, exemptions, lane rules, RFID discounts, construction diversions, or incomplete route data.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ESTIMATES WILL MATCH THE AMOUNT COLLECTED AT ANY TOLL PLAZA.

Always verify critical trip costs using official sources when accuracy matters.

7. Third-party services and links

The Service may link to third-party websites or apps (for example TRB, Waze, or Maps). We do not control and are not responsible for third-party content, terms, or privacy practices. Your use of third-party services is at your own risk and subject to those parties’ terms.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOLPH AND ITS OPERATORS, CONTRIBUTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR TRIP COSTS, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED PHP 1,000 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM (WHICH IS TYPICALLY ZERO BECAUSE THE SERVICE IS FREE), WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations. In those cases, our liability is limited to the fullest extent allowed.

9. Indemnity

You agree to defend and indemnify TollPH and its operators against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right—except to the extent caused by our willful misconduct.

10. Governing law & disputes

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. Courts located in Metro Manila shall have exclusive jurisdiction over disputes arising from these Terms or the Service, unless mandatory consumer protections require otherwise.

11. Changes, severability & contact

We may update these Terms from time to time. The “Last updated” date will change when we publish a revision. If a provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver.
